    TIME LIMITS

    There are time limits for all injury cases. These deadlines are called "limitation dates" because they were (for the most part) created by the Statutue of Limitiaiton. Each province has its own Statute of Limitations  and the deadlines vary from province-to-province:

    The limitation deadline means that you must file a lawsuit by a certain time, or you may lose your right to compensation. Once the lawsuit is filed, the court then imposes other deadlines for your case.

    Limitation deadlines are complicated because not all deadlines are listed in the Limitations of Actions Act. You should speak to a lawyer to determine all the deadlines that may apply to your case.

    I cannot stress enough the dangers of missing a limitations deadline. Please do not try to figure out the limitation deadlines on your own, it is too complicated. Please get legal advice from a lawyer experienced in personal injury and insurance law.

    If you think you may have missed a limitation deadline, contact a lawyer right away. There are sometime ways to get around a missed deadline, but it is essential that you act quickly, as this is one of the factors the judge would consider in allowing your case to go forward, despite the missed deadline.
